  • 1.  HIPAA Questions

    Today I received an email to my personal email address with a fax copy of a named person's health status and proposed healthcare plan with their diagnosis. I dont know any of the people or the insurance company involved.

    I believe it was sent to me in error by this persons insurance company. 

    I went to file a HIPAA complaint but it states if the error was made by an insurance entity that HHS has no jurisdiction. I believe this was a HIPAA violation and should be reported but I am not sure the path forward.

    I was able to navigate and submit. Somehow I was referencing life and auto insurance which is exempt from HIPAA per the HHS complaint website but not health insurers.

    Hi Ed and all

    Just a consideration for future.  States have privacy laws that go beyond HIPAA.  California has strict consumer privacy.

    So keep up the good reporting when relevant! (Not that we aren't all tracked continuously by cookies).

    Never thought when I started with small programs on punch cards that I would be "tracked by cookies!"  🀣🀣

    Hi Ed and all.

    Just to build on Ginger's message a little, I have also received several notices of claims and such from medical providers because they had the wrong email or house address on file somehow.  I have called both the insurance companies themselves as well as the providers to make them aware of the issue because they have obligations to also initiate investigations of these issues and create CAPAs as well.
