Please look at the Blue Guide:
https://ec.europa.eu/growth/content/%E2%80%98blue-guide%E2%80%99-implementation-eu-product-rules-0_enIt gives good explanations of the particular EU meanings of "placing on the market" and "putting into service".
For example, one point that could be relevant here: "
Placing a product on the market requires an offer or an agreement (written or verbal) between two or more legal or natural persons for the transfer of ownership, possession or any other property right concerning the product in question after the stage of manufacture has taken place."

Subject: Expired CE mark

I am doing a sanity check here - I recently joined a new company, and they had shipped several devices into the EU in 2017. The CE mark expired at the end of 2017. The devices are in a warehouse, and they tell me they are "entered into commerce". Except there was a unit placed last week, and a sale posted in our accounting system. It was sold to a hospital. I am being told that this is fine, as it was already in the EU. Well, the CE mark expired, and it wasn't placed into a site/sold, therefore was not placed into commerce. What's your opinion...
