The TSCA specifically excludes some things that are covered by other rules - pesticides, tobacco, food, food additives, drugs, cosmetics, devices...
You'll find that in the definitions section, 15 U.S.C. §2602.
Just for fun, if you go to www.epa.gov and enter FDA in the search box, you'll find lots of articles about areas where they're working on how to define the boundaries of their jurisdictions.
