    Hello all,

    Here is yet another question about the UKCA marking deadline. I have seen from some sources (notably, BSI: UKCA Marking Approval and Market Access in the UK) that medical devices may continue to be placed on the UK market until July 1 2024.

    However, sources from the UK government still indicate that the UKCA marking deadline is July 1, 2023 (Regulating medical devices in the UK). Elsewhere, there is language that the UK government intends to extend acceptance of CE marked devices (Implementation of the Future Regulations). However, I am curious where it is actually stated by the UK government that this date has actually been extended to July 2024 so as to validate what BSI has posted in the link above.

    Hello,

    it is indeed not always clear, especially not yet on the UK website

    The info I got on the RAPS convergence last month (from MHRA) is that the proposal to delay the UKCA marking till June 2025 !!

    This is even not the time that transition should be done, but from then onwards it will start.

    I t becomes mandatory for a company when the applicable MDR certificate has to be renewed. So, as MDR certificates can be for 5 years, this can give companies time till June 2030 !! If the MDR certificate was renewed just before the deadline

    The number of NB accreditted to audit for HMRA are still limitted, but BSI will also work on a kind of transfer project, for companies audiited by an MDR accreditted NB

    Hi Anon

    You are probably not alone in being slightly confused about this, because it has changed on a monthly basis and lots of elements have been presented as definitive facts, even by trusted organisations, without the caveat of the uncertainty associated with all of the announcements and drafts.

    Current UK legislation says that all medical devices must be UKCA marked from 1 July 2023 onwards.

    A draft amendment to that legislation introduces either a 5 or 7 year transition period for devices that are already CE marked with a valid CE certificate. This amendment does not alter the 30 June 2023 deadline. The 2024 date was announced by the MHRA (and then repeated by many) to accommodate the lack of progress with UKCA marking and all of the necessary moving parts, but it was announced/planned prior to the amendment of the EU MDR with Regulation (EU) 2023/607, and therefore it would not make sense to ignore the new EU transition periods for legacy CE marked devices. the 5 or 7 year period depends on the validity of the certificate, and will not allow for renewed certificates after July 2025.

    The 'new' UK medical device regulations are tentatively scheduled to be released in draft form later this year, with a likely date of application in June 2025. I would assume that this new legislation will also include transition periods for those devices that have been UKCA marked under the current UK regulations, giving them time to transition to the new requirements.

    Anon,

    What Ed said, but currently it is 1 July 2024 for CE Marked products being sold and distributed in the Great Britain (with other requirements for Northern Ireland).   Also keep in mind there are already requirements needed for even CE Mark products being distributed in the UK, e.g. Responsible Person, importer.

    The latest date I see for UKCA Marking is July 1, 2023. However, CE Marking dates are subject to Parliament approval for extension in the GB market, see below:

    "Currently, CE marked medical devices with a valid CE marking can be placed on the Great Britain market until 30 June 2023. A valid CE marking is a CE marking that enables the medical device to be placed on the EU market. However, subject to Parliamentary approval, we intend to introduce measures before 30 June 2023 which will provide that CE marked medical devices may be placed on the Great Britain market to the following timelines:

    • general medical devices compliant with the EU medical devices directive (EU MDD) or EU active implantable medical devices directive (AIMDD) with a valid declaration and CE marking can be placed on the Great Britain market up until the sooner of expiry of certificate or 30 June 2028
    • in vitro diagnostic medical devices (IVDs) compliant with the EU in vitro diagnostic medical devices directive (IVDD) can be placed on the Great Britain market up until the sooner of expiry of certificate or 30 June 2030, and
    • general medical devices including custom-made devices, compliant with the EU medical devices regulation (EU MDR) and IVDs compliant with the EU in vitro diagnostic medical devices regulation (EU IVDR) can be placed on the Great Britain market up until 30 June 2030."
