What is the differentiate between "do-it-yourself" and "supplied by registered dental professionals as take-home kits" for Teeth Whitening products? And what is the regulation or restriction of prohibition of sale for these Teeth Whitening products (i.e. lower/greater than 6% hydrogen peroxide or more than 18% carbamide peroxide) in Australia?

    Does anyone have experience with teeth whitening in Australia? I understand that Teeth whitening might not consider a medical device(s) product in most of countries but I would like to ask for your help and perspective in this matter.

    For "do-it-yourself" teeth whitening products for home use in the Australian market, we may have to refer to this bulletin:

    Do-it-yourself teeth whitening products supplied for home use are consumer goods and cosmetics and are subject to the Australian Consumer Law (which forms Schedule 2 to the Competition and Consumer Act 2010). The ACCC's position is that DIY teeth whitening products containing concentrations of greater than 6% hydrogen peroxide or more than 18% carbamide peroxide are unsafe for self-administered home use (see page 2 of 4, downloaded from attached link).
    And this provision does not apply to teeth whitening services provided by appropriately registered practitioners using chemicals and equipment on patients or clients in a surgery or commercial premises.
    What if the product with instruction of use "Follow your dentist's instructions on how to load gel into your custom bleaching tray"? Is it consider a "DIY" teeth whitening products (greater than 6% hydrogen peroxide or more than 18% carbamide peroxide)?

    My second question is, applicant may somewhat confused with the policy published by Australian Competition and Consumer Commission (ACCC) which is contradict with the SUSMP (Poison Standard) requirement. Moreover, ADIA (Australia Dental Industry Association) stated that SUSMP continue to be the only regulations and there is no need for the ACCC to regulate dentists and their capability to offer/issue teeth whitening and involve in this issue (prohibition of sale on DIY teeth whitening products which is greater than 6% hydrogen peroxide or more than 18% carbamide peroxide are unsafe for self-administered home use), please see details here Regulation of teeth whitening products in Australia - ADIA - Australian Dental Industry Association.

    The ACCC has advised that it is considering whether it will seek to set aside this regulation and put in place its own requirements; however, this statement was made in 2013 and no subsequent action has been forthcoming...
    Meanwhile, which one should we to follow/refer?
